Memorandum
Defending American Companies and Innovators from Overseas Extortion and Unfair Fines and Penalties
Summary
This memorandum establishes a policy of imposing tariffs and other responsive measures against foreign governments whose taxes or regulations discriminate against American companies, particularly in the technology sector. It directs the United States Trade Representative to determine whether to renew Section 301 investigations of the digital services taxes of France, Austria, Italy, Spain, Turkey, and the United Kingdom, and whether to investigate Canada's digital services tax or pursue a panel under the United States-Mexico-Canada Agreement. It further directs the Secretary of the Treasury, the Secretary of Commerce, and the United States Trade Representative to identify discriminatory foreign tax and regulatory practices, investigate European Union and United Kingdom measures affecting content moderation by U.S. companies, and establish a process for American businesses to report harmful foreign tax or regulatory practices.
