Memorandum
Limiting Lame-Duck Collective Bargaining Agreements That Improperly Attempt to Constrain the New President
Summary
This memorandum establishes an executive branch policy that collective bargaining agreements executed in the 30 days before a change in presidential administrations shall not be approved if they create new contractual obligations, make substantive changes to existing agreements, or extend an existing agreement's duration, though existing rollover provisions are unaffected. It directs agency heads to promptly disapprove any such agreement executed by subordinate personnel but not yet approved under 5 U.S.C. 7114(c). The requirements do not apply to CBAs primarily covering law enforcement officers, subject to a severability provision if that exclusion is held to defeat the memorandum's status as a government-wide rule. The Director of the Office of Personnel Management is directed to publish the memorandum in the Federal Register.
