Summary

This executive order declares a national emergency under IEEPA and the NEA with respect to threats posed by the Government of Cuba and establishes a tariff system under which an additional ad valorem duty may be imposed on imports from any foreign country that directly or indirectly sells or otherwise provides oil to Cuba. The Secretary of Commerce is directed to determine whether a country provides oil to Cuba, after which the Secretary of State, in consultation with the Secretaries of the Treasury, Commerce, and Homeland Security and the United States Trade Representative, recommends whether and to what extent duties should be imposed, with the President making the final determination. The order is effective at 12:01 a.m. eastern standard time on January 30, 2026, and supersedes inconsistent provisions of prior proclamations and executive orders.
