EO 14164
Restoring the Death Penalty and Protecting Public Safety
Summary
This EO states that it is the policy of the US to ensure laws authorizing capital punishment are respected and implemented. The Attorney General shall pursue the death penalty "for all crimes of a severity demanding its use" including every federal capital crime involving (1) the murder of a law-enforcement officer or (2) a capital crime committed by an alien illegally present in this country. The Attorney General shall also encourage the same for state capital charges, including ensuring that states have sufficient supplies of lethal injection drugs. The EO also directs various other actions to encourage capital punishment, including: modifying the Justice Manual; evaluating the cases of the 37 individuals who received federal death sentence commutations from President Biden, including encouraging evaluation of state charges; seeking overruling of Supreme Court precedents that hinder capital punishment; and prioritizing public safety and prosecution of violent crime.
