Presidential Waiver of Statutory Requirements Pursuant to Section 303 of the Defense Production Act of 1950, as Amended

This memorandum, addressed to the Secretary of War, determines pursuant to section 303(a)(7)(B) of the Defense Production Act of 1950 (50 U.S.C. 4533) that action is necessary to avert shortfalls in critical Department of War supply chains, and waives the requirements of section 303(a)(2)-(a)(6) of the Act for supply chains critical to reviving the defense industrial base. Covered supply chains include those supporting critical sectors identified in the September 2018 EO 13806 interagency task force report, including military aircraft, chemical/biological/radiological/nuclear protection, ground combat vehicles, nuclear warheads, radar and electronic warfare systems, shipbuilding, soldier systems, space systems, defense electronics and microelectronics, machine tools, the organic industrial base, and defense workforce training pipelines.
