Regarding the Acquisition of Certain Assets of Emcore Corporation by Hiefo Corporation

This EO finds credible evidence that HieFo Corporation—controlled by a citizen of the People’s Republic of China—may threaten U.S. national security through its completed April 30, 2024 acquisition of EMCORE’s digital chip and related wafer design/fabrication/processing assets, and asserts other laws are insufficient to address the risk. It therefore prohibits the transaction and any ongoing HieFo ownership, requires divestment within 180 days (subject to CFIUS extension), and imposes interim access, transfer, reporting, and audit/verification controls enforced and overseen by CFIUS.
