Adjusting Certain Delegations Under the Defense Production Act

This EO amends EO 13603 (National Defense Resources Preparedness), as previously amended by EO 14391 (Adjusting Certain Delegations Under the Defense Production Act), to adjust delegations of the President's Defense Production Act authorities. It adds the Secretary of the Interior alongside the Secretary of Energy for delegations concerning all forms of energy and energy production, construction, distribution, and use, with each Secretary able to act independently of the other. It also provides that energy-related disputes between the two Secretaries be referred to the National Energy Dominance Council, or to both that Council and the National Security Council in coordination with the Department of War when national defense infrastructure or military operations are implicated, and delegates authorities under section 101(c)(1)-(2) of the Act to the Secretaries of the Interior, Commerce, and Energy.
