National Security/DefenseGovernmental – National SecurityLitigationEnergy and InfrastructureEnvironmental

Summary

This proclamation exempts certain coal-fired stationary sources, identified in Annex I, from compliance with the EPA's May 7, 2024 rule amending the Mercury and Air Toxics Standards (MATS) under section 112 of the Clean Air Act for a two-year period beginning July 8, 2027, and concluding July 8, 2029. During the exemption period, those sources remain subject to the MATS compliance obligations as they existed before the 2024 rule. The President determines that the emissions-control technology required by the rule is not commercially available and that the exemption is in the national security interests of the United States.
