ActiveSigned October 24, 2025
Environment/EnergyGovernmental – National SecurityLand UseEnergy and InfrastructureEnvironmental

Summary

This proclamation exempts the primary copper smelters identified in Annex I from compliance with the EPA's May 13, 2024 Copper Rule (National Emission Standards for Hazardous Air Pollutants: Primary Copper Smelting Residual Risk and Technology Review and Primary Copper Smelting Area Source Technology Review) for 2 years beyond each of the Rule's compliance deadlines, invoking section 112(i)(4) of the Clean Air Act. During the exemption period, the listed sources remain subject to the emissions standards in effect prior to the Copper Rule. The President determines that the technology required by the Copper Rule is not commercially available and that the exemption is in the national security interests of the United States, citing EO 14220 (Addressing the Threat to National Security From Imports of Copper).
