EO 14193
Imposing Duties To Address the Flow of Illicit Drugs Across Our Northern Border
Summary
This EO expands the scope of the national emergency declared under Proclamation 10886 to include the failure of Canada to arrest, seize, detain, or otherwise intercept drug trafficking organizations (DTOs), other drug and human traffickers, criminals, and drugs. Further, a 25% ad valorem rate of duty is imposed on all products of Canada, beginning 2/4/25, except for goods entered for consumption. There is also an exception for energy resources, which are subject to a 10% ad valorem rate of duty (not 25%). The Secretary of Homeland Security is directed to modify the Harmonized Tariff Schedule of the US (HTSUS) to effect this order. The tariff does not apply to products eligible for admission under "domestic status" as defined in 19 CFR 146.43. Further, the Secretary of Homeland Security is directed to consult regularly with Secretary of State, AG, Assistant to the President for National Security Affairs, and the Assistant to the President for Homeland Security regarding the situation on the northern border. Secretary of Homeland Security must consult with Secretaries of Treasury and Commerce and AG to adopt rules and regulations to enforce this EO. All agencies shall take appropriate action to enforce this EO.
